What an Asian Beverage Importer Actually Does for a Producer Entering the US

Plain cardboard shipping cases stacked on pallets in a dim warehouse.

A producer cannot sell Asian beverages directly to US retailers or restaurants. Product moves through a licensed importer and then a licensed wholesale partner before it reaches a shelf or a menu. Knowing who does what in that chain keeps a producer from planning for work that belongs to someone else, or assuming someone else will do work that is theirs.

What the importer owns

The importer holds the federal permit, takes legal title when the product enters the country, and answers to regulators for it from that point on. That is why the importer, not the producer, appears on the US label and signs the filings.

The importer also manages relationships with licensed wholesale partners. A producer does not negotiate state by state. RTM Imports reaches all 50 states through its wholesale partner network and holds the compliance and licensing layer for that network. For the details of that layer, see the compliance and licensing page.

What the producer still owns

Handing a brand to an importer does not hand over the whole job. These stay with the producer:

  • Supply. Production capacity, consistent quality from batch to batch, and the lead time to replenish an order that sells faster than planned.
  • Export documentation. Paperwork that clears the product to leave the country of origin, prepared per the importer’s instructions.
  • Brand assets. Label artwork, product descriptions, photography, and any story the wholesale partners will use to sell the brand.
  • Product facts. Ingredients, production method, and alcohol content, stated accurately, because the importer’s filings depend on them.
  • FDA facility registration. The facility that makes the product must be registered with the FDA, through a US agent, before the first shipment.

A simple way to divide the work

Task Producer Importer
Production and supply planning Owns Receives forecasts
Export paperwork from the origin country Owns Directs
Label artwork and brand story Owns Reviews for US rules
Federal permit and legal title in the US Not involved Owns
Filings that make the product legal to sell Supplies facts Owns
FDA registration of the production facility Owns Can advise
Wholesale partner relationships Not involved Owns

Disagreements usually come from the gaps in this table, so settle each row in writing before the first order.
